Terms and conditions

This is an accurate statement of how we work, written to be read rather than to be survived. It has not yet been reviewed by an attorney and must be before it is presented for acceptance at checkout.
1. Who you are contracting with
Broker2Me is a trading name of Broker 2 Me Marketing Corp, a Florida corporation at 1701 Ponce De Leon Blvd, Suite 206, Coral Gables, FL 33134. In these terms "we" and "us" mean Broker 2 Me Marketing Corp, and "you" means the person or business booking the shoot.
2. What we agree to do
We photograph the property you book, using the services you select, and deliver the finished files to you. Photography and aerial coverage are included in every package. Anything else, Matterport, video, twilight or decluttering, is included only where you have selected it.
Every turnaround we quote is in business days. Where the site says 24 hours, two days or three days, it means one, two or three business days, counted from the day after the shoot. Weekends and public holidays do not count.
Photographs are delivered within 24 hours. Matterport tours within two business days. Video within three business days. Where weather, access or the size of the property makes that impossible we will tell you as soon as we know rather than let the date pass quietly.
3. Booking, notice and confirmation
A weekday slot offered by the booking calendar is confirmed as soon as you book it. We do not take a booking and then decline it.
Shoots require 3 business days' notice as standard, 2 for Priority Agents and 1 for Luxury Agents. Bookings made after 16:00 do not count that day toward the notice period.
We shoot Monday to Friday. Weekend dates can be requested, are confirmed by hand rather than automatically, and carry a $100 rush fee. Priority and Luxury Agents do not pay the rush fee, but a weekend date still has to be confirmed by us.
4. Price, travel and payment
The price shown in the booking flow before you confirm is the price. It is calculated from the living area on the county property record, the services you select, and the travel involved. Where the county record is wrong, or where the property is materially different from what was booked, we will tell you on the day and agree any change with you before we invoice it.
Travel within about an hour of us is free. Beyond that it is $100 per hour, shown to you in the quote before you book and never added afterwards. Some distant areas carry a set fee instead, which is also shown before you book.
Payment is due on delivery unless you are on a monthly plan, in which case shoots are billed on your plan's cycle.
5. Preparing the property
You are responsible for the property being ready and accessible at the booked time. Ready does not mean empty. It means lights on, blinds open, surfaces clear, cars off the driveway and pets secured.
If the property is not ready we will still shoot it. Your photographer will open blinds and turn lights on, but will not move furniture or tidy, because handling other people's belongings is how things get broken. Two things follow: the shoot takes longer than the estimate, and whatever is left out appears in the photographs. Decluttering can remove it in post if you have booked it.
If we cannot get access at the booked time, we will wait a reasonable period and then treat it as a late cancellation under section 6.
6. Changing or cancelling a shoot
You can move an upcoming shoot yourself, free of charge, up to 8 hours before it starts. Inside that window it still goes through, because a client who cannot reschedule simply does not show up and an empty driveway costs everyone more, but it carries a $50 late notice charge.

7. Weather
We shoot in cloud, drizzle and after rain, and every exterior is given a blue sky in the edit at no extra charge. Only heavy rain stops a shoot, and only because the equipment cannot be out in it. Where that happens we reschedule at no cost to you.
8. Your licence to use the images
We retain copyright in everything we shoot. On payment you get a perpetual, non exclusive licence to use the delivered files to market the property, including on the MLS, listing portals, social media, print and your own website.
That licence covers you, and the seller and brokerage for the same listing. It does not extend to reselling the files, licensing them to a third party such as a portal or a developer for their own marketing, or using them to advertise a different property. We may use the images in our own portfolio and marketing unless you ask us in writing not to.
9. How long we keep your files
About 12 months. Please download and keep your own copy. We hold files for about a year, and we cannot promise they are still here after that.
10. Limits
If we fail to deliver a shoot, our liability is limited to what you paid for that shoot. We are not liable for consequential losses such as a delayed listing or a lost sale. Nothing in these terms limits liability that cannot be limited by law.
We are not responsible for the accuracy of information taken from the county property record, which is a public source we read on your behalf and which you are asked to check during booking.
11. Governing law
These terms are governed by the laws of the State of Florida, and the courts of Miami Dade County have exclusive jurisdiction.
